Course Syllabus

Abstract

This introductory course on comparative law is designed for students interested in studying foreign legal systems who possess a solid knowledge of English. The course discusses the nature of ‘traditional’ comparative law, its functions, aims, methods and history. It then surveys the main features of the world’s major legal families (civil law, common law, non-Western legal traditions in Asia and mixed jurisdictions) and maps the world’s legal systems. It introduces the basic research methods of traditional comparative law confronting them with the extended methods of “postmodern” comparative law. The course also provides a methodological approach to conducting a comparative analysis.

  • The course introduces students to the main approaches of ‘traditional’ comparative law, including its functions, objectives, methods and history. It also intends to survey the main features of the world’s major legal systems (civil law, Anglo-American common law, non-Western legal traditions in Asia, Sharia and mixed jurisdictions), providing students with an overview of legal systems around the world. The course introduces the study of comparative law in today’s (de)globalised world, using the extended methods of “postmodern” comparative law and a contextualised approach to legal systems and institutions. The course introduces students to the steps involved in a comparative analysis, including identifying preliminary considerations, research questions, and the choice of legal systems.

  • Students will learn to recognise the methodological approaches of traditional and postmodern comparative law. This will give them an overview of the issues and questions of comparative law, such as: — How a specific legal problem can be addressed in a specific country? — What is the difference between common law and civil law? — What are the global taxonomies of legal systems? — How can legal systems be influenced by personal and political biases?
  • Students will learn to recognise the methodological approaches of traditional and postmodern comparative law. This will give them an overview of the issues and questions of comparative law, such as:— How can the socio-legal context explain why the law differs between countries? — Could legal transplants be successful? — How can comparative methods be applied to research convergence, regionalism, and internationalisation? — How can comparisons be used to evaluate transnational and global norms?
