Course Syllabus
Abstract
"Common law" is a legal family that includes legal systems that have a number of common features (sources of law, style of thinking, legal terminology, features of judicial systems, etc.). At the same time, the countries included in this legal family retain a number of independent features due to the nature of their formation. English law and US law occupy a special place in the legal family. They have a significant impact on the development of other legal systems, primarily Canada and Australia. The NISa will also consider "mixed jurisdictions" - the legal systems of some Asian and African countries, in which different legal cultures, including common law, are represented
Learning Objectives
- The course is primarily aimed at providing students the necessary tools to understand and study common law legal systems: English law, USA law, law of Canada, Australia, countries of mixed jurisdictions. During the course such issues as judicial precedent, court system, distinct features of public and private law in the common law countries will be examined. In addition, the following will be considered in detail: modern legal reforms in common law countries, general tendencies of common law development. Among other aspects, students will explore the following topics: • English law: from Saxon, Norman law to common law; • Federalism and common law (USA, Canada, Australia); • Constitutional principles in common law countries; • Civil rights and freedoms; • Judicial remedies; • Civil law in common law countries
Expected Learning Outcomes
- Students should gain the following competencies and abilities: as an introduction to this seminar, students will explore methodology of comparative legal studies. They will also study how to fulfill research of English and American law
- The students should gain the following skills and abilities at the heart of this special course in the study of judicial precedents, basic legislation in the common law countries
