Course Syllabus

Abstract

Upon completion of this course, students should understand the following: the basic concepts, categories, and institutions of public law in a number of BRICS countries and some Western jurisdictions; the specifics of social relations in foreign countries governed by public law; constitutional regulation of the status of the individual, and the constitutional principles of economic, social, and political systems; the formation, development, and existence of basic legal families; the state-territorial structure and existing models of the organization and functioning of public law in foreign countries; the state-territorial structure and existing models of the organization and functioning of the system of supreme and local authorities, state power, and administration in a number of foreign countries. The course also covers a general understanding of constitutional and state theory, providing students with conceptual tools for comparing different systems. As a result, students will gain an in-depth knowledge of the methods of comparative constitutional law. Recommended knowledge: the general theory of state and law, the history of the national state and law, the history of the state and law of foreign countries, constitutional, administrative, and financial law.

  • Defines markers of constitutional identity of the countries under study.
  • Analyzes the features of the territorial-state structure.
  • Formulates human rights standards taking into account regional specifics.

  • Challenges for the UK legal system in the context of Brexit and domestic political instability.

    По итогам дисциплины предусмотрена подготовка реферата. Реферат – это композиционно организованное, обобщенное изложение содержания источников информации (статей, монографий и др.) по определенной тематике, с элементами сравнительного анализа данных материалов и с последующими выводами. Основная цель написания реферата – изложить идеи, представленные в реферируемых источниках, раскрыть основные тезисы исходного текста. Основное требование к реферату – его аналитический характер, полнота источниковедческой базы. Тема реферата выбирается в рамках дисциплины студентами самостоятельно и согласовывается с преподавателем. Технические требования к реферату дополнительно доводятся преподавателем до сведения студентов перед экзаменом. Реферат необходимо загрузить в установленный срок в систему Smart LMS.
