Course Syllabus
Abstract
During this course students will study the concept, subject, history, sources, subjects, special principles of international sports law and the peculiarities of resolving sports disputes. The course comprises two parts.
In the first part the course covers the process of legal regulation of international sports relations at the universal level within the framework of the United Nations and its specialized agencies and programs and at the regional level within the framework of the Council of Europe and the European Union, as well as the process of corporate regulation within the framework of sports organizations of the Olympic and Paralympic Movement (lex sportiva). The course identifies such problem areas as doping in sport, fan violence and hooliganism, environmental protection in the organization of international sport competitions, economic crime and discrimination in international sport, use of Olympic symbols, countering threats to health and safety.
In the second part the course students will study normative acts that provide the basis for the composition, procedural requirements for the formation and functioning of jurisdiction bodies of the International Federation of Football (FIFA) and the International Court of Arbitration for Sport (CAS). They will have an opportunity to participate in two role games that simulate the course of sports dispute resolution within the framework of FIFA and CAS, respectively.
Learning Objectives
- The main purposes of the course is to form the understanding of the essence, current state and trends in the development of international sports law governing interstate cooperation in the field of sports and lex sportiva - a set of norms developed by international sports organizations of the Olympic and Paralympic movement in order to identify key problems (such as doping, manipulation of sports competitions, other manifestations of corruption in sports; ensuring safety, security and maintenance of sports matches; environmental protection in the preparation and conduct of international sports competitions) and possible solutions to them, as well as to describe basic procedures for resolving sports disputes and their application in practice.
Expected Learning Outcomes
- Students should gain the following competences: • ability to work with information (search, evaluate, use information, necessary for fulfilment of academic and professional tasks, from various sources, including application of the systematic approach); • ability to carry out professional activities in the international environment; • ability to search, analyse, and work with relevant information by using the juridical, comparative and other specific methods,
- Students know subjects, sources and principles of international sports law; institutional foundations of international legal regulation in the field of sports; subjects, sources and principles of lex sportiva.
- Students know institutional foundations of transnational corporate regulation in the field of sports; key problem areas in the field of sports and possible ways of their legal and corporate regulation.
- Students know composition and procedural requirements for the formation and functioning of jurisdiction bodies of sports organizations and the International Court of Arbitration for Sport (CAS).
- Skills and abilities: ability to use specific terms and sources of international sports law and lex sportiva; practical abilities to carry out research and analysis of international legal and corporate acts, judicial decisions, arbitral awards, and legal writings; skills to analyse and solve cases, elaborate a legal position and compose procedural documents in sport disputes.
- Students should gain the following competences: ability to describe legal problems and situations in the field of international sports law and lex sportiva.
