Course Syllabus

Abstract

The jury trial is one of the most significant institutions of modern criminal justice, ensuring the direct participation of citizens in the administration of justice. This form of judicial proceedings has deep historical roots in Russia and has received a new development in recent decades. The discipline "Peculiarities of criminal proceedings involving jurors" is devoted to an in-depth study of the procedural procedure for the consideration of criminal cases involving jurors, provided for in Section XII of the Criminal Procedure Code of the Russian Federation. The course covers the theoretical foundations and practical aspects of this form of legal proceedings, including the specifics of jurisdiction, the procedure for forming a jury, judicial investigation, debate of the parties, raising questions and passing a verdict, as well as appealing court decisions. The course provides seminars where students will be able to test their knowledge by analyzing specific situations, solving cases, analyzing judicial practice, evaluating and critically comprehending the advantages and disadvantages of jury proceedings. The course is aimed at developing a comprehensively developed specialist who is ready to work effectively in the context of constantly changing legislation and law enforcement practice, who is able to professionally apply the norms of the Criminal Procedure Code of the Russian Federation in the context of conflicts and gaps in law, evaluate law enforcement practice and develop motivated judicial acts.

  • Topic 2. Historical models and the evolution of the jury trial in Russia: comparative legal aspect
  • Topic 3. The procedural procedure for filing a petition and assigning a criminal case to a hearing with the participation of jurors
  • Topic 4. Formation of the jury panel: legal basis and tactical features of the selection procedure
  • Topic 5. Features of judicial investigation with the participation of jurors: subject matter, limits and rules of evidence admissibility
  • Topic 6. The procedural role of the chairman: a parting word, a question sheet and legal mentoring
  • Topic 7. Psychological and legal mechanisms of decision-making and verdict-making by a panel of jurors
  • Topic 8. Legal consequences of the verdict: the qualification of the deed and the appointment of punishment by the presiding judge
  • Topic 9. The Institute for the Review of judicial decisions rendered on the basis of a verdict. Modern problems and prospects of jury trial development
