Course Syllabus
Abstract
The course delivers an overview of the key concepts of law taking into account their relation to public policy issues. It is planned to provide the students with the general knowledge of legal philosophy and its main principles with an emphasis on the issues of public good, social contract, and political regimes. The course will analyze how philosophical underpinnings influence policy-making processes, particularly in areas like social justice, ethics, and governance. Through a combination of theoretical discussions and case studies, participants will get acquainted with how philosophical principles shape legal frameworks and inform policy decisions and develop an understanding of how legal philosophy relates to public policy debates. The course discusses the foundations of critical theory of state and law, basic theories of the Cambridge School of the history of political thought, and modern theories of legal validity through the lens of legal positivism.
Learning Objectives

- To provide students with the global outlook in contemporary theories of legal thinking and their origins: from ancient thought to up-to-date theories of legal validity
- To equip students with skills of legal methods applied for interpretation of statutory law and court practice in the domain of public policy
- To build up firm knowledge of key issues at the crossroads of legal philosophy and public policy
Expected Learning Outcomes
- To guide students through the general political and legal concepts applied on public policy and legal philosophy including law, authority and political obligation
- To provide students with the global outlook in contemporary theories of legal thinking and their origins: from ancient thought to up-to-date theories of legal validity
- To provide students with skills of legal methods applied for interpretation of statutory law and court practice in the domain of public policy
- To build up firm knowledge of key issues at the crossroads of legal philosophy and public policy
- To provide students with the global outlook in functions of public law and public policy, justice and morality, primary and secondary rules in the framework of a legal system.
- To obtain comparative and analytical insights into the principled interrelation between legal philosophy and public policy by comparing classical and modern theories, including those of the Cambridge school of thought and its perspectives towards the concepts of the State and the Republic.
- To articulate the historical evolution of the sovereign state concept and analyze its significance in shaping contemporary notions of state authority, freedom and law.
- To be able to discuss and rethink major issues in legal philosophy and political theology.
- To provide an overview of legal clauses and exceptions from the validity of law, classify the types of political regimes, debate prudence and the problem of modern state limitations.
- To trace development of legal and political theories of interpretation over time, identifying how shifts in philosophical and critical perspectives have shaped contemporary understandings of legal concepts.
- To assess challenges related to communication within legal and policy-making processes, drawing on modern and postmodern theoretical perspectives related to discourses of power, knowledge and faith.
- To assess and debate an interplay between legality and the truth.
- To obtain comparative and analytical insights into the principled interrelation between legal philosophy and public policy in the contexts of inclusive and exclusive legal positivism.
