Аннотация

The Theory of International Law course is designed to provide an in-depth, multifaceted view of the doctrine and practice of international law and to broaden the horizons of those who have already studied international law. The course begins with an overview of the main contemporary theories of international law, including positivism, New Haven (and New New Haven), constitutionalism and global administrative law, critical legal studies, and international law and economics approaches. Other topics include international law-making, the formation of international customs, the doctrines of sources and hierarchy of international law, the relationship between international and domestic law, state compliance with international law, and state responsibility. The course provides students with an advanced understanding of the international regulatory system and prepares them to engage with complex issues of international law through research and critical analysis.
